The Trump administration submitted its notice of appeal to the US Court of Appeal of the Colombia County Department shortly after Jackson’s rule.

Jackson wrote that the court “finds that eliminating the restrictions imposed on the removal of the plaintiff will be a fatal and basic advantage of the Special Advisor’s Office as perceived by Congress and its signature in the President’s Law: its independence. The court concludes that they must stand.”

Jackson wrote: “It will be paradoxes, the least said, and the parties that are strengthened by the statute if the Special Adviser himself can cool in his work with fear of arbitrary or partisan removal,” Jackson wrote.

Jackson’s decision comes after the United States Supreme Court stopped the Trump administration’s efforts to reject Delling. The Trump administration had asked the Supreme Court to flip the temporary Delinger to the minimum court.
