Section 28 is vital to victims
I was interested in reading Danny Show’s article regarding the use of a pre -registered interrogation in favor of the complainants in criminal trials (“Moj accused the study of video “spinning” with rape convictionsThe news). Section 28 is a special procedure forbidden for survivors in cases of sexual crimes, in appreciation of the shock of providing evidence – an experience that many describe as worse than sexual violence itself. Sherrill Thomas Ki Ci claims that conviction rates are less when survivors use section 28, but without there being convicted of less than that many survivors will not provide evidence.
Justice means more than many condemnations alone. The procedural justice – which is dealt with fairly, can be dignified and give an opportunity to express their experiences – the same importance as the recovery process, and Article 28 can help the transmitters of miller to achieve this.
We agree that our courts require urgent investments, but the current discourse confuses cases related to accumulation and technology with the use of Article 28. This is not very useful, not at least for these survivors of sexual violence and abuse who, without Article 28, will not have justice.
